Terms & Conditions for Stockholm eBikes
1. General and definitions
This Agreement sets out the Terms of Use (hereinafter the Terms & Conditions) that the user must comply with in order to use the city bike system "Stockholm eBikes" (hereinafter the Service). The service is produced by CityBike Sweden AB (hereafter CBS) on behalf of the City of Stockholm.
Stockholm eBikes is a system of city bikes that users can rent from marked stations. The Terms & Conditions apply to all content of the Service unless otherwise notified or agreed upon for certain parts. Each rental period (hereinafter Trip) starts when the User unlocks a city bike and ends when the User has parked the city bike in a city bike station in accordance with the instructions in section 5 below, ended the Trip and received a receipt from the system that the Trip is completed. Instructions for handling are available on the Service's website and in the app. The address of the Service's website is www.stockholmebikes.se and the apps can be downloaded from the Apple appstore and Google Play under the name "Stockholm eBikes", together these constitute the official communication channels (hereinafter Communication Channels).
The user of service (hereinafter the User) must be a physical person who is at least 18 years old, is registered as a User of the Service and has approved the applicable Terms & Conditions. In order to start a Trip, a valid Pass is required, which provides access to the Service for a defined period of time and with defined conditions, such as the number of Trips and included time for Trips (hereinafter Pass).
CBS reserves the right to deny a User access to the Service and/or immediately suspend the User from the Service if they have violated their obligations under the Terms & Conditions.
2. Registration and personal data
In order to use the Service, the person must register as a User in one of the Communication Channels and register an approved payment method. After CBS has approved the User's registration as a User of the Service, the User has the right to use the Service in accordance with the Terms & Conditions.
The login details are personal and may not be shared with others. The Service may only be used for the User's personal use. The User is responsible for all use of the Service that occurs and for any costs, fees, liabilities, and obligations that the use of the Service entails.
The user can review their data in the Communication Channels. If the User forgets their login details or loses their card used for checking out city bikes, new login details can be ordered in the Communication Channels. The User may deregister as a User of the Service through the Communication Channels. Upon deregistration, the User is not entitled to a refund of already charged prices and fees and is obliged to pay for the use of the Service that has taken place but has not yet been charged.
When a person registers as a User of the Service, he or she shall provide the information required for the use of the Service. CBS processes the User's personal data in accordance with the EU General Data Protection Regulation (679/2016) and other applicable legislation. Further information on the collection and processing of personal data is described in the Privacy Policy available in the Communication Channels.
3. Availability and content of the service
The availability of the service is posted in the Communication Channels. In exceptional cases, the service may be out of service at one or more city bike stations. The availability of city bikes may vary and at the stations of the city bike system there are not necessarily available city bikes or free space to park the city bike. The User is not entitled to a refund or other compensation for temporary lack of availability, technical fault or the like.
CBS develops the Service and has the right to modify the Service and its content as part of its regular operations in the manner and at the times that CBS deems best.
4. Customer service
Contact details to the customer service are posted in the Communication Channels.
5. Use of the Service
The User undertakes to use the Service in accordance with the Terms & Conditions and pay for the use of the Service in accordance with the applicable price list.
All City Bikes covered by the Service are owned by CBS. The User's rental of city bikes means that the User has the right to use city bikes for their normal personal use during the Pass. The User is responsible for the rented city bike during the Trip. It is the responsibility of the User to exercise normal caution with a rented city bike. If the city bike is damaged or lost in connection with the Trip, what is stated therein in these Terms & Conditions applies. CBS reports any form of suspected vandalism or theft of city bikes.
The User is responsible for checking that the city bike is in safe and driveable condition before it is put into service. Things should always be checked before a city bike is put into service:
If any of the above parts or functions are missing or deficient, or if the city bike is otherwise not in safe and driveable condition, it is prohibited to drive the city bike. In such a case, the User shall immediately return the city bike to the city bike station and report the city bike in the Communication Channels. CBS is not responsible for any damages resulting from the User's lack of safety- and function control or use in violation of the driving ban as described above.
A Trip must not exceed 14 hours. It is the User's responsibility to end the Trip by parking the city bike in a city bike station and ending the Trip. If space is not within the marked area of the city bike station, the city bike shall be parked directly adjacent to the city bike station without blocking any walking or cycling paths, carriageways, loading areas, pedestrian crossings, bus stops, exits, doors or entrances. The city bike should be parked so that it is easily accessible to other users or CBS service personnel.
If, as a result of a technical fault, the Trip cannot be completed correctly, the User shall pause the rental and send an email to support@stockholmebikes.se with a photograph showing the entire city bike and its parking, a description of the fault, the city bike ID number and the city bike station or location of the city bike.
The User must comply with applicable laws, and local traffic regulations and regulations. The User may not use the city cycle under the influence of alcohol, drugs, medicine, or any other substance that may impair the User's ability to safely use the city bike. The city bike may only be used on prepared roads and cycle paths, and suitable surfaces and places that cannot be expected to damage the urban cycle. The city bike must not be used for off-road driving, competitions or similar events.
The User is always personally responsible for any fines issued by the Police, this also applies to technical deficiencies on the city bike - for example, non-functioning brake, no or broken bell or lack of lamps. If the city bike lacks any safety function required by law, the city bike may only be routed and returned in a city bike station and reported to CBS.
A maximum of one person is allowed to ride the city bike at a time. Passengers are not allowed. The User may load a maximum of 10 kg into the basket on the handlebars. The User should wear a helmet.
The User rents the city bike solely for his personal use, the city bike may not be borrowed, rented or otherwise made available to third parties. Commercial use of city bikes is not allowed. Examples of unauthorised commercial activities are couriers, food deliveries, itinerant sales, sightseeing or other commercial purposes. Users who break the rules will be blocked from the Service and paid fees will not be refunded. For commercial use of the system, a separate Pass is required, contact CBS for more information.
The city bike shall be returned in the same condition in which it was rented. If the city bike is destroyed in such a way that it cannot be repaired, the compensation shall be equivalent to that of the lost city bike as set out in section 6 below. Dismantling, unloading, screwing or in any way manipulating parts of the city bike is prohibited and counts as vandalism.
If a city bike in connection with a Trip is involved in an accident or for any other reason is damaged, or if a city bike is stolen or otherwise lost, the User undertakes to notify CBS Customer Service within two (2) hours of it occurring, and to make a police report within two (2) days. A copy of the police report should be sent to CBS.
Commercial use of CBS and Stockholm eBike's trademarks and logos is not permitted without the consent of CBS.
6. Prices and other remuneration
All applicable prices and fees, as well as the available Passes with their respective terms and limitations, are defined in the price list found in the Communication Channels.
If the User does not complete the Trip within the prescribed maximum rental period of fourteen (14) hours, the User will be charged a fee according to the applicable price list.
If the User loses the city bike or if the city bike is otherwise lost, or destroyed so that it cannot be repaired, the User is obliged to replace CBS with an amount equal to the value of the city bike. The amount is calculated by CBS per day for the User's loss report to CBS. If a Trip is not completed or the city bike is not otherwise returned to CBS within three (3) days, the city bike is normally considered lost.
For City bikes that have not been parked in accordance with the instructions in section 5 above, the User will be charged a parking fee according to the applicable price list.
7. Change of conditions
CBS has the right to change these Terms & Conditions as well as the terms of the Passes and price list. Such change will take effect 14 days after the change has been published on the Service's website. However, for ongoing Passes, significant changes to the terms and conditions of the Passes or price list will only take effect after the period of the Pass has ended or been extended.
8. Limitation of liability, applicable law and settlement of disputes
CBS is not responsible for damages incurred as a result of the User's failure to comply with these Terms & Conditions or the instructions for handling. CBS' liability is in any event limited to direct damages caused by CBS negligence. The User's possible claim against CBS in connection with the Service shall, in order to be asserted, be made to CBS no later than three months after the User became aware of or should have become aware of the circumstance on which the claim is based.
For the Terms & Conditions and the Service, Swedish law applies. Any dispute in connection with the Service shall primarily be resolved through negotiations between the parties. If the parties are unable to reach an agreement, the dispute can be examined by the General Complaints Board (Allmänna Reklamationsnämnden), if the Board considers itself competent and the dispute is suitable for such review. A decision by the General Complaints Board is a recommendation and not binding on any party. Ultimately, a dispute is decided by a Swedish general court.
Användarvillkor för Stockholm eBikes
1. Allmänt och definitioner
I detta avtal fastställs användarvillkoren (härefter Användarvillkoren) som användaren ska följa för att få använda stadscykelsystemet ”Stockholm eBikes” (härefter Tjänsten). Tjänsten produceras av CityBike Sweden AB (härefter CBS) på uppdrag av Stockholms stad.
Stockholm eBikes är ett system med stadscyklar som användare kan hyra från markerade stationer. Användarvillkoren tillämpas på allt innehåll i Tjänsten om inget annat meddelats eller avtalats om för vissa delar. Varje hyresperiod (härefter Cykeltur) startar när Användaren låser upp en stadscykel och avslutas när Användaren har parkerat stadscykeln i en stadscykelstation i enlighet med anvisningarna i avsnitt 5 nedan, avslutat hyran och mottagit en kvittens från systemet att hyran är avslutad. Instruktioner för handhavande finns på Tjänstens webbplats och i appen. Adressen till Tjänstens webbplats är www.stockholmebikes.se och apparna kan laddas ner från Apple appstore och Google Play under namnet ”Stockholm eBikes”, tillsammans utgör dessa de officiella kommunikationskanalerna (härefter Kommunikationskanaler).
Den som nyttjar Tjänsten (härefter Användaren) ska vara en fysisk person som är minst 18 år gammal, ha registrerat sig som Användare av Tjänsten och godkänt de gällande Användarvillkoren. För att kunna starta en Cykeltur krävs ett giltigt Pass, som ger tillgänglighet till Tjänsten under en definierad tidsperiod och med definierade villkor, exempelvis inkluderade antal Cykelturer och inkluderad tid för Cykelturer (härefter Pass).
CBS reserverar sig rätten att neka en Användare tillgång till Tjänsten och/eller omedelbart stänga av Användaren från Tjänsten ifall denne brutit mot sina skyldigheter enligt Användarvillkoren.
2. Registrering och personuppgifter
För att kunna använda Tjänsten ska personen registrera sig som Användare i någon av Kommunikationskanalerna samt registrera en godkänd betalningsmetod. Efter att CBS godkänt Användarens registrering som Användare av Tjänsten, har Användaren rätt att använda Tjänsten i enlighet med Användarvillkoren.
Inloggningsuppgifterna är personliga och får inte delas med annan. Tjänsten får endast användas för Användarens personliga bruk. Användaren svarar för all användning av Tjänsten som sker och för de eventuella kostnader, avgifter, ansvar och skyldigheter som användningen av Tjänsten medför.
Användaren kan granska sina uppgifter i Kommunikationskanalerna. Om Användaren glömmer sina inloggningsuppgifter eller förlorar sitt kort som använts för utcheckning av stadscyklar kan nya inloggningsuppgifter beställas i Kommunikationskanalerna. Användaren kan avregistrera sig som Användare av Tjänsten genom Kommunikationskanalerna. Vid avregistrering saknar Användaren rätt till återbetalning av redan debiterade priser och avgifter samt är skyldig att betala för användning av Tjänsten som har skett men ännu ej debiterats.
När en person registrerar sig som Användare av Tjänsten ska han eller hon lämna de uppgifter som förutsätts för användningen av Tjänsten. CBS behandlar Användarens personuppgifter i enlighet med EU:s allmänna dataskyddsförordning (679/2016) och annan gällande lagstiftning. Närmare information om insamling och behandling av personuppgifter beskrivs i Integritetspolicyn som finns i Kommunikationskanalerna.
3. Tjänstens tillgänglighet och innehåll
Tjänstens öppettider anslås i Kommunikationskanalerna. Tjänsten kan i undantagsfall vara ur funktion vid en eller flera stadscykelstationer. Tillgängligheten på stadscyklar kan variera och vid stadscykelsystemets stationer finns inte nödvändigtvis lediga stadscyklar eller ledig plats att parkera stadscykeln. Användaren har inte rätt till återbetalning eller annan ersättning för tillfälligt bristande tillgänglighet, tekniskt fel eller liknande.
CBS utvecklar Tjänsten och har rätt att ändra Tjänsten och dess innehåll som en del av sin vanliga verksamhet på det sätt och vid de tidpunkter som CBS anser bäst.
4. Kundservice
Kontaktvägar till Tjänstens kundservice anslås i Kommunikationskanalerna.
5. Användning av Tjänsten
Användaren förbinder sig att använda Tjänsten i enlighet med Användarvillkoren och betala för användning av Tjänsten i enlighet med den gällande prislistan.
Alla Stadscyklar som omfattas av Tjänsten ägs av CBS. Användarens hyra av stadscyklar innebär att Användaren har rätt att vid Cykelturer under Passet använda stadscyklar för sitt normala personliga bruk. Användaren ansvarar för hyrd stadscykel under Cykelturen. Det åligger Användaren att iaktta normal försiktighet med hyrd stadscykel. Om stadscykel skadas eller försvinner i samband med Cykeltur gäller vad som anges därom i dessa Användarvillkor. CBS polisanmäler alla former av misstänkt skadegörelse eller stöld av stadscyklar.
Användaren ansvarar själv för att kontrollera att stadscykeln är i säkert och kördugligt skick innan den tas i bruk. Följande saker ska alltid kontrolleras innan en stadscykel tas i bruk:
Om någon av ovanstående delar eller funktioner saknas eller är bristfälliga, eller om stadscykeln av annat skäl inte är i säkert och kördugligt skick, är det förbjudet att köra stadscykeln. Användaren ska i sådant fall omedelbart returnera stadscykeln till stadscykelstationen och felanmäla stadscykeln i Kommunikationskanalerna. CBS ansvarar inte för eventuella skador som uppkommer till följd av Användarens bristande säkerhets- och funktionskontroll eller användning i strid mot körförbud enligt ovan.
En Cykeltur får inte överstiga 14 timmar. Det är Användarens ansvar att avsluta Cykelturen genom att parkera stadscykeln i en stadscykelstation och avsluta hyran. Om plats inte finns inom den markerade ytan på stadscykelstationen ska stadscykeln parkeras i direkt anslutning till stadscykelstationen utan att blockera några gång- eller cykelvägar, körbanor, lastytor, övergångsställen, busshållplatser, utfarter, dörrar eller entréer. Stadscykeln ska parkeras så att den är lättillgänglig för andra användare eller CBS servicepersonal.
Om Cykelturen till följd av tekniskt fel inte kan avslutas korrekt ska Användaren pausa hyran och skicka ett mail till support@stockholmebikes.se med ett fotografi som visar hela Stadscykeln och dess parkering, en beskrivning av felet, stadscykelns ID-nummer och vilken stadscykelstation eller plats stadscykeln finns på.
Användaren ska följa gällande lagar, och lokala trafikföreskrifter och förordningar. Användaren får inte använda stadscykeln under påverkan av alkohol, droger, medicin, eller någon annan substans som kan försämra Användarens förmåga att på ett säkert sätt använda stadscykeln. Stadscykeln får bara användas på preparerade vägar och cykelvägar, och lämpliga underlag och platser som inte kan förväntas skada stadscykeln. Stadscykeln får inte användas för terrängkörning, tävlingar eller liknande arrangemang.
Användaren är alltid personligt ansvarig för eventuella böter som Polisen utfärdar, detta gäller även för tekniska brister på stadscykeln - exempelvis ej fungerande broms, ingen eller trasig ringklocka eller avsaknad av lyktor. Om stadscykeln saknar någon säkerhetsfunktion som krävs enligt lag får stadscykeln enbart ledas fram och ska återlämnas i en stadscykelstation och felanmälas till CBS.
Maximalt en person får åka på stadscykeln åt gången. Passagerare är inte tillåtna. Användaren får maximalt lasta 10 kg i korgen på styret. Användaren bör använda hjälm.
Användaren hyr stadscykeln enbart för sitt personliga bruk, stadscykeln får inte lånas, hyras eller på annat sätt tillgängliggöras till tredje part. Kommersiellt nyttjande av stadscyklarna är inte tillåtet. Exempel på ej tillåten kommersiell verksamhet är budverksamhet, matleveranser, ambulerande försäljning, sightseeing eller andra kommersiella syften. Användare som bryter mot reglerna kommer bli blockerade från Tjänsten och inbetalda avgifter kommer ej återbetalas. För kommersiellt nyttjande av systemet krävs ett separat Pass, kontakta CBS för mer information.
Stadscykeln ska återlämnas i samma skick som den hyrdes ut i. Om stadscykeln skadas till följd av åverkan, användning i strid mot Användarvillkoren eller Användarens vårdslöshet har CBS rätt till ersättning för den reparationskostnad som därigenom uppkommer. Om stadscykeln förstörs så att den inte går att reparera ska ersättningen motsvara vad som gäller för förlorad stadscykel enligt avsnitt 6 nedan. Att avmontera, lossa, skruva eller på något sätt manipulera delar på stadscykeln är förbjudet och räknas som skadegörelse.
Ifall en stadscykel i samband med en Cykeltur är delaktig i en olycka eller av annan orsak skadas, eller ifall en stadscykel blir stulen eller på annat sätt förkommer, förbinder sig Användaren att meddela detta till CBS kundtjänst inom två (2) timmar från att det inträffat, samt att göra en polisanmälan inom två (2) dygn. En kopia av polisanmälan ska skickas till CBS.
Kommersiell användning av CBS och Stockholm eBikes varumärken och logotyper är inte tillåten utan medgivande från CBS.
6. Priser och andra ersättningar
Alla gällande priser och avgifter, samt de tillgängliga Passen med deras respektive villkor och begränsningar, definieras i prislistan som återfinns i Kommunikationskanalerna.
Om Användaren inte avslutar Cykelturen inom den föreskrivna maximala hyrtiden om fjorton (14) timmar kommer Användaren debiteras förseningsavgift enligt gällande prislista.
Om Användaren tappar bort stadscykeln eller om stadscykeln på annat sätt förkommer, eller förstörs så att den inte går att reparera, är Användaren skyldig att ersätta CBS med ett belopp motsvarande stadscykelns värde. Beloppet beräknas av CBS per dagen för Användarens förlustanmälan till CBS. Om en Cykeltur inte avslutas eller om stadscykeln inte på något annat sätt återlämnas till CBS inom tre (3) dygn, räknas stadscykeln normalt som försvunnen.
För Stadscyklar som inte har parkerats i enlighet med anvisningarna i avsnitt 5 ovan kommer användaren debiteras felparkeringsavgift enligt gällande prislista.
7. Ändring av villkor
CBS har rätt att ändra dessa Användarvillkor samt villkoren för Passen och prislistan. Sådan ändring får verkan 14 dagar efter att ändringen har publicerats på Tjänstens webbplats. För pågående Pass får väsentliga ändringar i villkoren för Passen eller prislistan dock verkan först efter att tidsperioden för Passet har upphört eller förlängts.
8. Ansvarsbegränsning, tillämplig lag och avgörande av tvister
CBS ansvarar inte för skador som uppkommit till följd av att Användaren inte följt dessa Användarvillkor eller instruktionerna för handhavande. CBS ansvar är under alla förhållanden begränsat till direkta skador som förorsakats av CBS vårdslöshet. Användarens eventuella anspråk mot CBS med anledning av Tjänsten ska, för att kunna göras gällande, framställas till CBS senast tre månader efter det att Användaren fick kännedom om eller borde ha fått kännedom om den omständighet som ligger till grund för anspråket.
För Användarvillkoren och Tjänsten gäller svensk lag. Eventuell tvist i anledning av Tjänsten ska i första hand försöka lösas genom förhandlingar mellan parterna. Om parterna inte kan komma överens kan tvisten prövas av Allmänna reklamationsnämnden, om nämnden anser sig behörig och tvisten är lämplig för sådan prövning. Ett beslut av Allmänna reklamationsnämnden är en rekommendation och inte bindande för någon part. Ytterst avgörs en tvist av svensk allmän domstol.
